			<content:encoded><![CDATA[<p>The hot topic in Orange County is of course the number of motorcycle accidents that have begun to crop up as of late, including one involving  a <a title="article" href="http://www.ocregister.com/articles/motorcyclist-driver-crash-2526337-matrix-reportedly">Garden   Grove man</a> who died while lane splitting .  While many people are trying to blame lane splitting, proponents say the practice is safe if both motorcyclist and car drivers pay attention and obey the rules of the road.</p>
<p>Which leads to the topic of what the true cause of recent <a title="motorcycle accident" href="http://www.camotorcyclelawyers.com/category/motorcycle-accidents/wrongful-death-motorcycle-accident/">motorcycle accident related deaths</a> has been.  People who say lane sharing is the culprit do not have the data to back that up.  Current research does exists however, that seems to indicate that many motorcycle collisions are caused by  speeding, improper turning or  passing, and unsafe lane changes.   Motorists who disregard the motorcycles right-of-way also cause more biker injuries and deaths that any hot-dogging, wheelie popping shenanigans do.</p>

<p>While most acknowledged it was indeed legal, many car drivers expressed aggravation with the trend, with one going so far as to say that he wished he could “open his car door and knock the rider off his bike”…</p>
<p>With such hostility one has to wonder how many of the<a title="lane splitting" href="http://www.camotorcyclelawyers.com/category/lane-splitting/"> lane splitting accidents</a> accidents are truly “accidents” at all.</p>

			<content:encoded><![CDATA[<p>A two-vehicle collision that killed a motorcyclist in San Diego is now undergoing further investigation by police. According to police, the motorcyclist could have been splitting lanes to cause the motorcycle accident. The man, identified as Hope Domiguez, was a worker at a local Harley Davidson and was actually headed to work at the time of the accident.</span></span></p>
<p>At around 8:43 on Wednesday, traffic seems to have backed up as the <a href="http://www.camotorcyclelawyers.com/2009/08/ventura-county-motorcyclist-killed-after-road-rage-incident/">motorcycle accident</a> ensued. Dominguez was riding the motorcycle and began to split through lanes of traffic, likely in an effort to get to work on time, but grazed another vehicle on the highway, a Toyota Matrix, beginning the motorcycle accident. Dominguez then fell from his bike and a Buick on another lane ran him over. He remained alive for some time while underneath the Buick. However, California Highway Patrol reports that the man died later underneath his vehicle.</span></span></p>

<p>“<a href="http://www.camotorcyclelawyers.com/2009/03/motorcycle-helmets-lane-splitting-in-california/">Lane splitting</a>” or &#8220;<a href="http://www.camotorcyclelawyers.com/2009/03/motorcycle-helmets-lane-splitting-in-california/">lane sharing</a>&#8221; occurs when a motorcyclist (or bicyclist) rides his or her bike between two cars going in the same direction. In California,  the law allows motorcycles and bicycle to lane split and or lane share  so long as it is done in a “safe and prudent manner.” The California Highway Patrol acknowledges the right of motorcyclists to drive this way, but if the speed of traffic reaches a steady rate of 20 to 25 miles per hour or more, the CHP advises the motorcyclist to drive in a lane with the flow of traffic.</p>
<p>Because the <strong>motorcyclist has the right to split lanes</strong>, drivers must be aware of the possibility of a motorcyclist approaching it from the rear and passing it. A driver is careless (“negligent”) if he or she suddenly change lanes without signaling in time for an oncoming motorcyclist to take appropriate action to avoid a collision with the vehicle. A driver must give the proper turn signal and look in his or her rear-view and side mirrors to ensure that no motorcycles are approaching. If a motorcycle is in fact approaching, the driver of the car must wait for the motorcycle to pass before changing lanes.</p>
<p>The motorcycle operator should be looking 10 cars ahead, watching for signs that a car is going to make a sudden lane change or if there is not sufficient space between two cars to be able to split the lane. Studies show that lane splitting may actually reduce the number of accidents, as the lane splitting motorcyclist has better control over his or her motorcycle and can veer around any obstacle, while not being able to avoid a rear-end collision if he were riding behind the car.</p>

A brief honk of the horn may alert the driver of your presence, thereby avoiding the chances of your being hit. Keep your eyes on the road, several cars ahead of you, to see those first signs of a change in speed, debris on the road, or other event that that changes the speed or direction of traffic. Of course, if you’re lane splitting, you risk the driver tossing out the window a half-empty cup of coffee or other beverage that may cause you to lost control of your bike. But this is a minor insult when compared to the driver who cuts you off by changing lanes without signaling, causing you to be severely injured.</p>

<p>In California, it is <strong>r</strong><strong>equired by </strong><strong>law to wear a helmet</strong> while riding a motorcycle.  It is still unclear to me how a motorcycle helmet would prevent a car from making an illegal u-turn or from getting struck by a drunk driver.  Many bikers who wear helmets are killed each year because the careless driver didn&#8217;t look or make an effort to pay attention.  1st5ive.com has an <a href="http://www.1st5ive.com/harley-davidson/motorcycles/2009/02/2604/motorcycle-crash-lane-splitting-in-california/">amazing video posted of a biker</a> who was lane-splitting and was hit by a careless driver making an illegal lane change.</p>
<p>The other motorcycle topic mostly discussed in California is that of <strong>lane splitting</strong>.  This is when a biker shares a lane with other vehicles, or rides in between two lanes.  This is completely LEGAL!  For many reasons, California has correctly allowed bikers to lane split.  Some motorcycles have an air-cooling motor which requires the wind to keep the engines temperatures at reasonable settings.  In addition, one of the benefits of riding a motorcycle in California is to get out of traffic.</p>
<p>Check out this video.  This is the exact reason why its important for all bikers to wear a helmet cam when they can.  With the negative stigma that bikers have today, having video of what exactly happened will keep the at-fault party from lying!  </p>
