			<content:encoded><![CDATA[<p>A motorcyclist was taken to a local trauma center shortly after an <a title="motorcycle accident" href="http://www.camotorcyclelawyers.com/category/motorcycle-accidents/">injury inducing accident </a>where his toes were severed.  The accident occurred Thursday at around 11:50 a.m. near a Gaslamp Quarter intersection.  The motorcyclist had been traveling westbound  when he ran a red light at Sixth Avenue and Broadway.  He smashed into a Toyota Camry that was heading southbound after which three of his toes were severed.  Police closed the intersection to clean up the wreckage and investigate the scene.</p>

<p>There are many people postulating on the reason for the increase in<a title="wrongful death" href="http://www.camotorcyclelawyers.com/category/motorcycle-accidents/wrongful-death-motorcycle-accident/"> motorcycle crashes and fatalities,</a> with some postulating that it could be the fact that motorcycle registration has risen to roughly 7 percent.  Studies suggest otherwise as NHSTA research indicates that fatality rates can outpace resignation rates.  In 2005-2006 FARS (Fatality Analysis Reporting System) data showed that motorcycle registration actually decreased by 1.6 percent while fatality rate increased by 5.7 percent.</p>
<p>It is far too easy to try to single out a single culprit and claim that this is the sole reason for motorcyclist injury and death, but the reality is there are numerous reasons why any accident can occur.</p>

			<content:encoded><![CDATA[<p>Defective equipment really relates to two separate elements: (1) <strong>a defect in the motorcycle itself which caused the operator to lose control of the bike</strong>, or (2) a <strong>defect in the protective clothing and helmet the motorcyclist was wearing at the time of the accident</strong>, resulting in death or more severe injuries than the motorcyclist would have sustained had the protective gear not failed, particularly if the helmet was defective.</p>
<p>Examples of things that can go wrong include <strong>defective brakes</strong> that fail, defective tires, <strong>defective gas tank</strong><strong>s</strong> and hoses that create a fire hazard, defects in the chain that cause it to break, accelerators that stick, snapped brake cables, or seats that fail under normal use. A defective helmet with a faulty restraining strap can fly off the motorcyclist’s head. Or the helmet may be made out of inferior materials that fall apart from the impact with the road or a fixed object.</p>
<p>There are two types of defects in the making of a motorcycle: (1) <strong>a design defect</strong> that renders all motorcycles made according to the specifications dangerously defect, and (2) <strong>defects in manufacturing</strong>, in which individual motorcycles are improperly manufactured.</p>
<p>In a defective design case, the dangerous defect is in every make and model of a particular motorcycle. When the design defect is discovered, there may be a recall of the motorcycle to fix the dangerous defect. Because of the motorcycle’s inherent design defect, it makes the motorcycle unsafe to ride or likely to cause injuries to or deaths of the motorcyclists.</p>
<p>In a manufacturing defect on a particular motorcycle, the motorcycle may be properly and safely built according to proper and safe specifications, but something happened in the manufacturing process to make the individual motorcycle unsafe. For example, a welder may not do his or her job correctly, and the motorcyclist is severely injured when, while riding the bike, the bad weld fails, resulting in death or serious injury to the motorcyclist.</p>
<p>In addition to defects in the design or manufacturer of motorcycles that cause injuries to unsuspecting motorcyclists, the second category of injury result from the failure of protective gear—including helmets—to do its job effectively, thereby leaving the fallen motorcyclist with severe abrasion burns, broken bones, “road rash,” and, in the case of a defective helmet, traumatic brain injury (TBI) that can range from a mild headache to the complete inability to function and take care of yourself, requiring the need for around the clock attendants. Such an injury to the head and brain can even result in the death of the motorcycle operator and his or her passenger. Proper gear can save you from sustaining abrasion burns if you are dragged a ways or if you are ejected from the motorcycle.</p>
<p>When you have been injured by a <a href="http://www.camotorcyclelawyers.com">defective motorcycle</a>, you are entitled to sue the motorcycle store that sold you the motorcycle, the distributor of the bike, and the manufacturer of the bike. If you bought a used motorcycle from a private party, you generally cannot sue the person who sold you the motorcycle, as sales of used property—including motorcycles—between third parties are considered “as is” sales: you take the product as it is, defects and all. It is up to you to inspect the motorcycle or take it to a motorcycle mechanic before buying it and having the mechanic examine the motorcycle for problems or potential problems. However, if it turns out that the used motorcycle you bought from a third party does indeed have a defect in design or manufacturing that causes you, your passengers, and even other motorists or pedestrians injury, you can still sue the manufacturer and distributor of the bike for the defect in design or manufacture.</p>

Whether it’s bandana, t-shirt, jeans and boots to leather chaps, motorcyclists have their own distinct style, and they are not timid about showing it off; and why should they be? Just as any other community, the fashion world when related to bikers has also changed.  Fashion has hit the biker community. Let’s look at some of the ways.</p>
<p class="western">Motorcycle fashion has now hit the main stream fashion runways as it did in the past. First, Dior, Chanel, and Laura Pieralis copied biker style and sold them to the rich and famous. Now, couture for the fashion conscious motorcyclist has emerged. Witness Arlene The Biker Queen who has designed for Arlen Ness a series of some 40 different clothing pieces for bikers. Whereas before, motorcycle fashion was bought by the rich, it is now being bought into by the motorcyclists themselves.</p>
<p class="western">Called the Arlen Ness Chopper Couture, Arlene is providing mostly female but also male bikers with fashion designed for their passion—motorcycles. It’s not protective gear, but rather high quality for when you attend the Oscars and Cannes Film Festivals and want to show off the fact that you are a biker. The Chopper Couture motorcycle fashion has been sold in North America since 1999, but has since reached the European shores. The design concept for the Arlen Ness Chopper Couture was to create a contemporary line of California Motorcycle inspired street couture for the stylish woman.</p>
<p class="western">What is amazing about biker fashion, however, is that not only bikers are interested in wearing it. What used to be garb exclusive to bikers, has now spread to the masses. Everywhere we go we see motorcycle jackets, biker boots, or leather pants. ..and these are worn by non-riders! What is the appeal?</p>
<p class="western">Prominent is the toughness one feels when donning motorcycle wear. That toughness has resulted from the image of the biker wearing leather since day one. Men in black leather jackets, leather pants, with high-cut boots embracing the pedal gives us the impression of invincibility. They portray themselves as not to be reckoned with, intimidating and kings of the road. Therefore, it is this persona that non-bikers love to put on when they don the couture of the biker.</p>
<p class="western">Another aspect of the biker that the non-biker likes to take on when he wears his/her clothes is the sense of adventure intrinsic to a biker. Inside a person might be a closet bungee jumper, but outside dressed in biker’s clothes, he is a thrill-seeking adventurous motorcyclist.</p>
<p class="western">Another reason why people want to dress like bikers is to communicate their individuality. Black boots and shiny leather is sure to capture attention over the casual docker/sporty look.
